Cynthia Marcotte Stamer Biography Cynthia Marcotte Stamer has extensive experience advising and representing U.S. and international businesses and governments in a diverse array of human resources, employee benefits, public policy, and operational issues. For more than 22 years, Ms. Stamer has assisted businesses domestically and internationally to address labor and employment, compensation, employee benefits, immigration, safety, and other operational and regulatory requirements and challenges arising from employment, outsourcing, and other services relationships. Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization, Ms. Stamer continuously assists employers to develop and administer practical solutions to personnel and staffing, compensation, performance management, discipline and other employment and employee benefit concerns. Ms. Stamer is sought out for her experience assisting public and private employers, staffing and outsourcing companies, insurers and others to coordinate and properly manage the risks and relationships between labor and employment, employee benefit plans and ERISA, outsourcers and other vendors as well as corporate risk management, insurance and health care matters. Known for her high accessibility and ability to respond to triage crisis and other emergent legal and business concerns, business leaders value Ms. Stamer for her ability to help their business formulate and implement real time solutions to emerging workforce challenges ranging from individual employee performance concerns to responding to workplace disasters as well as assisting clients manage risk and improve operations through the use of creative workforce and other management practices. On a daily basis, Ms. Stamer provides “on-demand” counseling to businesses on human resources and staffing issues arising out of their business operations and on how to design, administer and defend their management and compliance policies and practices involving employment, internal controls, compensation, hiring and firing, employee benefit, promotion and discipline, safety and other issues. As an ongoing part of this practice, Cindy frequently helps businesses and business leaders manage employment and employee benefit exposures and compliance concerns arising out of workforce reductions, job restructuring, outsourcing, corporate mergers, acquisitions, sales, bankruptcies, and other significant business and workforce changes. She has extensive experience helping employers design, document, implement, and defend individual and mass employment transition, termination and layoff selection procedures and decisions to reduce liability under employment discrimination, whistleblower, workers' compensation, employee benefit and other applicable laws. Cindy's experience includes advising employers about the use, documentation, implementation, and defense of employment termination, promotion and review practices, voluntary and involuntary severance pay arrangements, early retirement windows and other incentive retirement arrangements, settlement agreements, ADEA and other waivers, and other employment and employee benefit risk-management strategies; amendment and termination of employee benefit and employment policies; termination, amendment, vesting, distribution, partial termination, tax-qualification, withholding, and other compliance obligations with regard to employee benefit plans; and compliance obligations under COBRA, WARN, discrimination, and other applicable laws. She also advises and represents investors, creditors and creditor committees, debtors, bankruptcy trustees, employee benefit plans and fiduciaries and others about dealings with distressed companies and employee benefit plans including risk assessment and mitigation, the administration, restructuring and termination of human resources and other services relationships; the administration, amendment or termination or employee benefit, compensation, and fringe benefit programs and practices, outsourcing, litigation or other investigation or enforcement actions by employees, contractors, plan participants and beneficiaries, and service providers, as well as the IRS, Department of Labor or other regulators arising out of workforce and staffing, employee benefit and insurance practices and programs in ongoing operations, corporate or credit transactions, bankruptcy. She also advises and represents businesses about litigation, enforcement actions by the Labor Department, IRS, Homeland Security, HHS, Department of Justice, FTC and other federal and state agencies and other challenges to their staffing, compensation, and benefits practices. Business leaders and governments consult her for advice and representation in workforce, immigration, health, education and other policy matters. Her policy work includes experience serving as a lead consultant to the Government of Bolivia on the reform of its Social Security law, input on migration and other policy reforms to leaders in the US and Mexico, as well as extensive involvement in domestic labor and employment, health care, employee benefit and immigration reforms. Listed in the International Who’s Who of Professionals, Ms. Stamer’s insights on employment and other management matters have been widely published and quoted in numerous national and local publications including the Wall Street Journal, the Dallas Morning News, Business Insurance, World At Work, CEO Magazine and a host of other publications.
